Please carefully review the following Terms and Conditions for your trip and related services with Getaway by Tonya Jean Becker. This document constitutes an integral part of your contract. For any inquiries, please reach out to me at [email protected].

By accepting this receipt and making payments through Getaway by Tonya Jean Becker (referred to as the Company), the booking passenger (hereafter, Passenger) acknowledges receipt, review, and acceptance of these terms and conditions governing the contract for travel-related services.

COSTS OF SERVICE

Depending on the nature of the vacation planning services provided, Getaway by Tonya Jean Becker charges an initial service fee of $100. A service fee is a charge for making a transaction such as booking a hotel, a cruise, an airline ticket or a package; it allows an agent to compensate a portion of their extensive education.

Cost of Service charges are non-refundable and cover enhanced services beyond itinerary planning. All direct charges by Getaway by Tonya Jean Becker will be invoiced through my Stripe.

SUPPLIER PAYMENTS

Getaway by Tonya Jean Becker accepts Visa, American Express, Discover, and Mastercard for processing through our suppliers/vendors. Reservations are held until the “Deposit Due Date” specified on your confirmation. Getaway by Tonya Jean Becker requires final payment five (5) days before the vendor due date. Failure to make timely payments puts the booking at risk of cancellation. Passenger(s) hold Getaway by Tonya Jean Becker harmless for any cancellations due to late payment or credit card declination.

PRICING

Prices and availability quoted by Getaway by Tonya Jean Becker are not guaranteed until the deposit is fully paid. Pricing and availability may change without notice. Passengers acknowledge that the Company is not responsible for errors or omissions in quotes, advertisements, or on the website, leading to inventory, content, or pricing discrepancies. Getaway by Tonya Jean Becker reserves the right to charge passengers for any increases in taxes, fees, or surcharges.

BOOKING ACCURACY/LEGAL NAMES

Passengers are required to promptly review all booking details, including passenger full names (First, Middle, Last), addresses, contact information, and travel details. It is essential to report any errors to Getaway by Tonya Jean Becker immediately. Passengers are responsible for verifying the accuracy of their legal names as they appear on booking and travel documents.

PERSONAL TRAVEL DOCUMENTATION

Passengers are responsible for confirming all documentation requirements for passport, visa, vaccinations, or any other entry/travel requirements for each destination. Getaway by Tonya Jean Becker recommends consulting relevant government agencies for current document requirements.

AIRFARE

General Conditions Governing Air Transport

Getaway by Tonya Jean Becker does not independently provide airfare booking services; such services are exclusively available when combined with other offerings from Getaway by Tonya Jean Becker, including but not limited to cruise vacations, destination vacations, and escorted tours.

If a Passenger requires airfare in conjunction with their vacation plans, Getaway by Tonya Jean Becker may coordinate air travel either in collaboration with the supplier or through an Air Consolidator.

Airline tickets obtained through Getaway by Tonya Jean Becker are highly restrictive, non-refundable, and non-transferable. Any adjustments to passenger names, dates, times, routings, or departure/arrival airports are subject to the airline’s sole discretion and, if permitted, may entail substantial change fees. Passengers bear responsibility for any such fees. The Company acts as an intermediary between the Passenger and the airline; once a reservation is made, the credit card or debit card will be charged the specified amount, regardless of the actual use of the reservation. No credit will be given for unused airline tickets, and they cannot be applied to future bookings.

All tickets will be issued economy class unless otherwise specified, and travel will generally be round-trip unless stated otherwise. Seat assignments follow the policies of the respective airlines and may only be available at the airport on the day of departure. Airline tickets booked through Getaway by Tonya Jean Becker may not be eligible for earning frequent flyer miles. Passengers are advised to confirm all bookings with the airline prior to the stated date of departure (The company recommends confirmation at least 72 hours in advance).

Direct flights may be “non-stop” or involve one or more stopovers, with connecting flights subject to crew changes. For flights with a stopover in a town where the second flight departs from a different airport, Passengers are responsible for ensuring sufficient time for reaching the second airport at their own expense. Getaway by Tonya Jean Becker is not liable for reimbursing any costs incurred, and the Company bears no responsibility if the second flight is missed.

Getaway by Tonya Jean Becker responsibilities regarding air travel are constrained by the conditions of carriage of the relevant airline. The airline fulfilling the contract for carriage may differ from the one mentioned by Getaway by Tonya Jean Becker. The Company cannot specify the type of aircraft to be used by any airline. In cases of airline cancellations or delays, Passengers must coordinate directly with the airline to ensure timely arrival at the destination. Getaway by Tonya Jean Becker will not provide any refund for missed trips, whether in part or in full.

Luggage

Each airline has its own luggage policy. Passengers are advised to check with the airline in advance for weight restrictions and additional charges related to checked baggage. Any additional charges for checked or overweight baggage, including golf bags and oversized luggage, are the responsibility of the Passenger. If baggage exceeds the airline’s weight limit and excess weight is permitted, a supplement must be paid directly to the airline at the airport.

The airline is liable to the Passenger only for the baggage entrusted to it, following the compensation contemplated in international conventions and relevant statutes. In cases of damage, late forwarding, theft, or loss of luggage, Passengers should contact the airline, declare the damage or loss before leaving the airport, and submit a declaration with the originals of the travel ticket, baggage check-in slip, and the declaration. Getaway by Tonya Jean Becker strongly recommends obtaining an insurance policy covering the value of personal items.

Limitation of Liability for Air Transport

In addition to the limitations of liability outlined above, Passengers agree that Getaway by Tonya Jean Becker is not liable for any damages arising from or related to airline timetable changes, delays, cancellations, missed connections, mechanical problems, inclement weather, seating reassignments, lost/delayed baggage, screening, and security delays, refused boarding, or failure to check-in properly.

ACCOMMODATIONS

The term “Accommodations” within Getaway by Tonya Jean Becker pertains to lodgings provided to travelers, encompassing various options such as hotels, condos, quarters on cruise ships, motels, time shares, campgrounds, and resorts.

a. Accommodation Classifications

The star ratings assigned to hotels and other accommodation providers by the Company correspond to a classification system established as a reference point in alignment with local standards in the host country. It’s important to note that accommodations and the associated star designations may vary between countries. The descriptions provided by Getaway by Tonya Jean Becker are based on my knowledge of the establishments and feedback received from customers. While Getaway by Tonya Jean Becker cannot guarantee the availability or suitability of specific accommodations, efforts will be made to secure comparable alternatives if the desired accommodations are unavailable. Passengers may incur additional costs for upgrades, etc. In exceptional circumstances, such as technical issues or actions by third parties, suppliers reserve the right to replace the planned hotel with accommodation of the same category offering equivalent services. In such cases, the Company will promptly inform the Passenger.

b. Taking Possession of and Vacating Room

Hotel policies regarding check-in and check-out times can vary, and it is the responsibility of the Passenger to check with the hotel in advance to verify relevant policies and timings. Getaway by Tonya Jean Becker is not liable for any charges or damages resulting from the Passenger’s failure to take possession or vacate the assigned room in a timely manner.

c. Types of Room

Room classifications and amenities may differ among hotels and countries, requiring Passengers to check with the hotel beforehand to confirm the specific offerings during their stay. Getaway by Tonya Jean Becker does not guarantee that its descriptions and photographs precisely represent the individual rooms provided.

d. Infants

Parents traveling with infants are encouraged to bring appropriate food for their child, as it may not be readily available at the destination. Additional charges, such as those for a cot or heating baby food, may apply, and passengers should request these services when making reservations. Please note that the availability of such services cannot be confirmed.

e. Expectant Mothers and Health Considerations

Getaway by Tonya Jean Becker advises pregnant women to consult their doctors before making reservations to ensure that participation in the trip is appropriate. Passengers agree that Getaway by Tonya Jean Becker is not liable for any damages arising from the inability to participate in any or all of the trip due to pregnancy or related illness, and no compensation will be payable under such circumstances.

ACTIVITIES/EXCURSIONS/TOURS

Participation in certain activities may not be suitable for all ages or individuals with specific medical conditions. Getaway by Tonya Jean Becker cannot be held responsible for incidents or accidents resulting from passengers’ lack of vigilance.

It is possible that certain activities mentioned in the trip description may no longer be available due to climatic conditions, act of God, off-season stays, or insufficient participants. During the early or late seasons, certain activities, facilities (such as restaurants and swimming pools), or maintenance work may be impacted. Entertainment and sports activities may vary based on the number of guests and weather conditions, especially during peak seasons. Facilities like bars, restaurants, clubs, and onboard cruise activities may have irregular opening hours, subject to the management’s discretion. Getaway by Tonya Jean Becker is not liable for the unavailability of activities due to the reasons mentioned above.

Collectively participated sports activities are often organized by external providers, and any associated travel costs are the responsibility of the customer. These activities may be canceled at the organizer’s discretion if there is insufficient demand, without entitling participants to compensation.

By engaging in any activity, you acknowledge that it may involve inherent risks. To the maximum extent permitted by law, Getaway by Tonya Jean Becker, waives responsibility for bodily harm or death, lost, stolen, damaged, or destroyed property, and any other liability related to the use and operation of the activity. This includes actions or events occurring before, during, or after the activity.

BALANCE DUE/FINAL PAYMENT

Getaway by Tonya Jean Becker will provide advance notice to passengers before the final payment. The credit card used will be verified, and failure to pay may result in reservation cancellation. If the balance is not paid when due, Getaway by Tonya Jean Becker reserves the right to regard the reservation as canceled and will adhere to the following cancellation policies.

CANCELLATION AND MODIFICATION POLICIES

All cancellations or no-shows are subject to penalties imposed by the supplier and by Getaway by Tonya Jean Becker. Cancellation fees are reflective of the level of work that would have been completed by the given dates. The fee is per reservation. If you require a copy of these terms, please contact the supplier or your agent at Getaway by Tonya Jean Becker.

All cancellations MUST be notified in writing to the assigned agent at Getaway by Tonya Jean Becker. Once the agent has confirmed the cancellation request and has notified the Passenger of any cancellation fees imposed, the passenger’s cancellation will be confirmed via email when processed.

MODIFICATION POLICIES:

Once itinerary planning has commenced, should Passenger request modifications to their vacation, Getaway by Tonya Jean Becker has the right to implement the following change fees:

TRAVEL PROTECTION

Travel insurance protection is Strongly Recommended. As your travel agent, Getaway by Tonya Jean Becker has a professional responsibility to recommend the purchase of travel protection to protect both you and your vacation. While coverage is offered through certain carriers, we cannot compare all the policies or companies currently in the marketplace. This responsibility rests solely with you, the customer, and we advise you to conduct research and find coverage that best fits your individual needs. Getaway by Tonya Jean Becker is limited to advising you of the need for such coverage.

By declining travel protection, you acknowledge and accept liability for any cancellation penalties, damages, and/or out-of-pocket expenses incurred. You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage, and your confirmation will note “declined” next to the travel protection section. If you HAVE purchased travel protection, please remember to review your confirmation for accuracy and call us immediately if you believe you have travel protection, and your confirmation indicates declined. Failure to contact us will be considered a waiver of travel protection.

We urge you to read your policy when it arrives as it contains important information. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim.

All requests for service under the policy must be filed directly with the travel insurance provider, in accordance with the policy terms and conditions, which you, the passenger, are responsible for reviewing upon receipt of your travel protection policy. Getaway by Tonya Jean Becker is not able to give advice regarding possible cancellations and any associated claims processing. All queries regarding cancellation, penalties, coverage should be directed to your travel insurance provider. Please note that the travel insurance provider may not be allowed to discuss your claim with Getaway by Tonya Jean Becker due to privacy laws (e.g. HIPAA). Accordingly, you acknowledge that Getaway by Tonya Jean Becker cannot be involved in any aspect of your claim/request for service. Passengers acknowledge and agree that Getaway by Tonya Jean Becker has no control over the travel insurance provider or its coverage decisions, and as a result, Getaway by Tonya Jean Becker is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.

AGENT/INTERMEDIARY

Getaway by Tonya Jean Becker serves as a mediator between the Suppliers and the public. It does not possess or manage hotels, shore excursions, tours, transportation providers, cruise lines, vessels, airlines, travel protection companies, attractions, or other travel-related Suppliers providing goods or services for the Passenger(s)’ trip. Passenger(s) acknowledge and agree that Getaway by Tonya Jean Becker is not responsible for any loss, damage, delay, inconvenience, or injury to Passenger(s) or group members resulting from a breach of contract, act or omission, whether willful or negligent, criminal or otherwise, by any person other than Getaway by Tonya Jean Becker, including but not limited to these Suppliers, their employees, agents, servants, or representatives.

Suppliers retain the right to deviate from the direct, customary, and/or scheduled route or itinerary for any reason, without limitation, and without notice. Passenger(s) acknowledge and agree that Getaway by Tonya Jean Becker is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections, or any other condition beyond its control.

Getaway by Tonya Jean Becker recommends that all Passengers be in good physical and mental health and have medical approval to travel. If a Passenger feels they have a physical disability requiring special accommodation, this needs to be addressed prior to the trip deposit. If more than minor assistance is needed, Suppliers may require that the Passenger be accompanied by a companion who is capable of and responsible for providing such assistance. Suppliers often reserve the right to reject Passengers whose mental or physical condition may interfere with the itinerary. Passenger(s) acknowledge and agree that Getaway by Tonya Jean Becker shall be held harmless for all claims relating to Supplier rejection based on mental or physical condition.

While Getaway by Tonya Jean Becker prides itself on selecting top-quality Suppliers, no undertaking, guarantee, or warranty is given or shall be implied as to the fitness or condition of the Supplier’s accommodations, transportation, or any food, drink, medicine, or provisions supplied. Passenger(s) acknowledge and agree that Getaway by Tonya Jean Becker is not responsible for refunding, either fully or partially, any amounts paid due to unsatisfactory services from any supplier. In no event shall Getaway by Tonya Jean Becker be liable for any accidents occurring in hotels, resorts, airplanes/airports, buses/bus stations, trains/train stations, onboard a cruise ship, on tenders, on shore excursions, or during any mode of transportation encountered during the trip, resulting from equipment or any other cause. The Passenger admits a full understanding of the nature and character of the mode of transport and assumes all risks of travel, transportation, and handling of passengers and baggage.

CREDIT CARD DISPUTES

Passengers agree not to dispute charges with Getaway by Tonya Jean Becker to avoid financial penalties imposed by suppliers. The Company is not liable for any such penalties.

SUPPLIER VOUCHER ISSUANCE

If, because of cancellations or postponements, the Client is provided a voucher and opts for it instead of a refund, the Client acknowledges that Getaway by Tonya Jean Becker has no specific knowledge of the Supplier’s financial condition and assumes no liability for endorsing a credit. The Client agrees that Getaway by Tonya Jean Becker is not accountable for any failure of a supplier to honor trip credits due to supplier financial default or the expiration of vouchers.

LIMITATION OF LIABILITY

Without limitation, Passenger(s) acknowledge the risk and agree that Getaway by Tonya Jean Becker is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints imposed by any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks, or other waters, perils of navigation of any kind, theft, accidents to or from machinery, boilers, or latent defects even though existing at the commencement of the trip, desertion or revolt of crew, or lost/damaged/delayed luggage.

MODIFICATION OF TERMS AND CONDITIONS

The Terms and Conditions may be amended or modified by Getaway by Tonya Jean Becker at any time without notice. It is therefore essential that you consult the Terms and Conditions prior to making each booking, particularly to ensure what provisions are in operation in case they have changed since the last time an order was placed by you. Only those who have accepted the Terms and Conditions and affirmatively indicated their consent to be bound by the Terms and Conditions may make a booking with Getaway by Tonya Jean Becker. Without this acceptance, any order is subject to cancellation at any time. The failure of Getaway by Tonya Jean Becker to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Getaway by Tonya Jean Becker does not guarantee it will act against all breaches of these Terms and Conditions.
